In these General Terms and Conditions, the following definitions apply:

Article 2. Application

These general terms and conditions apply to all quotations, agreements and offers between Bloemsierkunst Jan Bosman and the customer. This can only be deviated from if agreed in writing.

 

Article 3. Offers and Agreements

All offers, quotations and agreements are without obligation and not binding unless confirmed by Bloemsierkunst Jan Bosman.

 

Article 4. Delivery times

Orders for sending flowers as gifts placed before 10:00 AM from Monday to Friday and before 9:00 AM on Saturday can be accepted be delivered the same day, if in stock. Flower art Jan Bosman does not deliver on Sundays and public holidays. The florist is free to deliver flowers ordered for delivery on a Sunday or public holiday the day before or the next working day after that. The time of delivery may vary as the florist has different agreements with the deliverers. Deliveries usually take place between 10am and 6pm on weekdays and between 10am and 4pm on Saturdays.
Bloemsierkunst Jan Bosman cannot guarantee an exact delivery time. Orders for funeral and bridal work must be placed at least 1 working day in advance to guarantee a correct delivery.

Article 5. Force majeur

If delivery cannot take place due to force majeure, Bloemsierkunst Jan Bosman will contact the customer in writing or by telephone. Bloemsierkunst Jan Bosman will indemnify itself against any form of compensation. Force majeure includes, among other things, extreme weather conditions, government measures regarding the accessibility of the receiver, interference on the internet (servers), telephone connections. In this case, the customer may decide to cancel the order or have it delivered at a different time.

 

Article 6. Prices

The prices that apply are indicated with the product you want to order. The photo shows the size shown. This can range from “small to “XXXL”.
Prices include 9% VAT or 21% VAT and 6.50 euro delivery costs will be added.
Delivery is only made to the places indicated in the information page “Our delivery area”.

 

Article 7. Payment

Payments can be made via iDEAL (Internet banking), PayPal, prepayment or cash on delivery. To regular business customers an invoice will be sent.

 

Article 8. Cancellation

The customer can place the order cancel by telephone until 1 working day before the specified day of delivery. After this, if the florist has already incurred costs, the order can only be canceled for a partial refund. An order that has already been delivered cannot be canceled if the customer has not provided correct delivery details and the like (time of funeral, patient discharged from hospital, etc.). amount paid, minus the administration costs will be refunded to your account within 14 days.

 

Article 9. Warranty/Conformity

We will carry out your orders as much as possible as shown in the photo, but due to seasonal influences we are sometimes forced to replace certain flowers with another type, but in the right color combination

Article 10. Complaint Handling

Complaints should be made in writing (preferably by e-mail to florist@bloemsierkunstjanbosman.nl) or by telephone to Bloemsierkunst Jan Bosman. Bloemsierkunst Jan Bosman will respond to complaints within 2 working days. If the ordered product has not been delivered, the customer must report this within 5 days, other complaints such as quality/time of delivery must also be reported within 5 days.

 

Article 11. Privacy

Bloemsierkunst Jan Bosman treats all customer information confidentially.

Article 12. Other

Bloemsierkunst Jan Bosman can change these terms and conditions without prior notice, the General Terms and Conditions as published on www.bloembinderij-heijendael.nl are the most recent. The general terms and conditions that are on the website at the time of the conclusion of the agreement will still apply if the general terms and conditions of the concluded agreement are amended. Downloading material from this website is entirely at your own risk.

 

 

Article 14 Approval period

The trial period, as referred to in the Civil Code 7 article 46d, does not apply to purchases from Bloemsierkunst Jan Bosman, as the products we supply can quickly become obsolete.

 

Article 15 Special days

On special days, such as Valentine’s Day, Mother’s Day, etc., orders can be placed at most 5 days in advance.
This is due to the generally strongly rising prices of certain items.
When submitting an order, Bloemsierkunst Jan Bosman will calculate the current price on the day of delivery.
For delivery, the remaining amount must be transferred to one of the bank numbers listed in the web store.
If you fail to pay the full amount of your purchase, Bloemsierkunst Jan Bosman will not deliver the item you have ordered, unless stated otherwise after contact.
